7 Steps to Obtaining a Facility Clearance
Obtaining a Facility Clearance (FCL) is a multi-step process that requires coordination with the Defense Counterintelligence and Security Agency (DCSA) and compliance with government security regulations. Here’s a breakdown of the key steps:
- Sponsorship – A company cannot apply for an FCL on its own; it must be sponsored by a government agency or a cleared contractor with a legitimate need to access classified information.
- Initial DCSA Contact & NISS – Once sponsorship is confirmed, DCSA will initiate the clearance process and provide access to the National Industrial Security System (NISS) system, where required documentation must be submitted
- Business Entity Verification – The company must provide legal and corporate information, including proof of U.S. ownership and control, articles of incorporation, and operating agreements. Foreign ownership, control, or influence (FOCI) will be assessed during this stage.
- Key Management Personnel (KMP) Clearance – Senior leaders, such as the Facility Security Officer (FSO), must undergo and obtain Personnel Security Clearances (PCLs) since they will oversee the company’s security program.
- Security Agreements & Requirements – Depending on the structure and FOCI determination, DCSA may require the company to implement security agreements, such as a Voting Trust Agreement, Special Security Agreement (SSA), or a Board Resolution to mitigate foreign influence risks.
- Facility Security Officer (FSO) Appointment – The company must designate an FSO who is responsible for implementing and maintaining its security program. The FSO must complete security training as required by DCSA.
- Security Reviews & Approval – DCSA will conduct an Initial Security Review (ISR) to assess the company’s readiness and compliance with security requirements. If all requirements are met, DCSA will grant the FCL at the appropriate classification level.
